Prepaid Data Top SIM Service Contract Terms

Article 1 (Definition of Terms)

The definitions of terms used in these Terms and Conditions (hereinafter referred to as "these Terms and Conditions") are as follows:

(1) The Company Brastel Co., Ltd.
(2) IIJ Internet Initiative Japan Inc.
(3) This Service A telecommunications service for data communication, provided by the Company using IIJ's telecommunications equipment under the name TOP SIM as an OEM service.
(4) SIM The physical SIM card and eSIM (embedded SIM) used in this service.
(5) eSIM Profile A data file containing subscriber information that is downloaded and used on smartphone devices instead of a physical SIM card.
(6) This Contract The contract for the provision of this service is from the Company to the Contractor.
(7) The Contractor The person who has entered into this contract with the Company.


Article 2 (Application of Terms and Conditions)

The Company shall provide this Service through these Terms and Conditions.

Article 3 (Changes to Terms and Conditions)

The Company may change the contents of these Terms and Conditions.

Article 4 (About Service)

  1. The details of this Service can be found at https://shop.brastel.com.
  2. The Company reserves the right to change the content of this Service.
  3. The service area for this Service is restricted to regions within Japan as designated by the Company.
  4. This Service is provided through the IIJ MVNO platform. Data communication and internet connectivity are managed by IIJ.
  5. This Service is provided using the telecommunications network of NTT DOCOMO, INC.  Mobile data communication services are offered on a best-effort basis, and we do not guarantee coverage area, signal strength, communication speed, or any other aspect of service quality.
    Communication quality may vary depending on factors such as your location, surrounding environment, network congestion, maintenance or construction work, weather conditions, and the specifications, settings, and compatibility of your device. In addition, the Service may be unavailable or communication quality may be degraded in locations where radio signals are obstructed, such as underground facilities, tunnels, mountainous areas, inside buildings, remote locations, or other areas with poor signal propagation.

Article 5 (Usage Procedures)

  1. After purchasing the physical SIM and/or eSIM (hereinafter collectively referred to as “SIM”), the user must complete the activation process for the Service using the method specified by the Company.
  2. Regardless of the previous clause, the SIM purchase agreement is finalized once the payment is completed and the package is delivered. After that point, returns or exchanges of the package are not allowed.
    Please note that due to the nature of eSIMs, they can only be used once and cannot be reissued or reused. For this reason, eSIMs are not eligible for return, exchange, or refund—even if they haven’t been activated.
  3. To use this Service, the user must have a SIM-unlocked device that supports the LTE/4G frequency bands used by NTT DOCOMO. If using an eSIM, the device must also be compatible with eSIM technology.
    Please note that even if a device supports the frequency bands used by NTT DOCOMO's LTE/4G network, we do not guarantee communication quality, communication speed, or connectivity in all locations, frequency bands, or network environments. Depending on the device's specifications, settings, supported frequency bands, and other factors, the Service may not function properly or may not be available.

Article 6 (SIM Exclusive App)

  1. The user must download the "Top SIM App" (hereinafter referred to as "the App") provided by the Company onto their device. This App is required to activate and recharge the Service.
  2. The user is responsible for any communication costs incurred during the download and use of the App.
  3. The Company may collect information such as device names, operating systems, and App identification IDs (collectively referred to as "App User Information"). This does not include personal details like names, email addresses, or credit card information. This data is used for service provision and to enhance user convenience.
  4. All intellectual property rights, including copyrights and trademarks related to the App’s content and programs, belong to the Company or the content providers. The App is for personal use only, and unauthorized reproduction of any content is prohibited.
  5. If the user violates the provisions of the preceding paragraph and any issues arise related to copyrights or other intellectual property rights, the user is responsible for resolving these issues at their own expense and must not cause any inconvenience or damage to the Company.
  6. The Company does not guarantee that the App will be compatible with all devices used by Contractors.
    1. Even with the recommended operating system version, the App may not function properly on certain devices.
    2. This App was developed specifically for smartphones and is not guaranteed to work on tablets.
    3. Additionally, the App can only be used within Japan and is not intended for use with international communication, including VPNs or other overseas routes.

Article 7 (Usable Period)

  1. The service period is either 37 days or 60 days from the date the data communication is first established using the SIM. However, in the case of an eSIM, the service period shall be determined based on the plan selected by the Contractor. Furthermore, if additional data plan recharge procedures are completed within this period, the service period and validity will be extended from the current expiration date to the expiration date of the new plan. Any remaining data will be carried over with each extension; however, the total carryover period cannot exceed 180 days from the recharge date. After the service expiration period date, the Contractor has 7 days to recharge; however, any remaining data will be reset to 0GB when the plan expires.
  2. If the data communication capacity is exhausted within the plan's validity period, the communication speed will be reduced to 200kbps. After the plan expires, any remaining data capacity will be reset and invalidated.
  3. The usage period for any additional data communication volume obtained through additional data plan recharge will be as follows:
    • The data communication volume available due to the additional data plan recharge will be valid for the period specified by the Company at the time of the recharge.
  4. Notwithstanding the above, if the total data communication volume (including additional data plans) reaches the predetermined limit specified by the Company, the provision of this Service will end.

Article 8 (Restrictions on Transfer of Rights, etc.)

  1. The Contractor may not transfer the right to receive this Service or the SIM card to any other party.
  2. The Contractor may not permit any third party to use this Service.

Article 9 (SIM ID (ICCID), Barcode on the Physical SIM Card, and eSIM Activation Code)

  1. The Contractor is responsible for managing the phone number, ICCID information, the barcode printed on the SIM card, the activation code issued for the eSIM profile, and other related information (collectively referred to as "ID, etc.") associated with the SIM and must not allow any third party to use them.
  2. The Company may request the Contractor to present the ID, etc., when exercising their rights under these Terms and Conditions.
  3. The Company is not liable for any damage incurred by the Contractor or any third party resulting from the theft or loss of the ID, etc., or SIM card.

Article 10 (eSIM Profile)

  1. The eSIM profile can only be downloaded once and cannot be reissued or reused.
  2. An internet connection is required to download the eSIM profile.
  3. When downloading the eSIM profile, the Contractor must manually enter the activation code into the device’s settings screen and, if necessary, complete the APN settings according to the procedures provided by the Company.
    If data communication occurs within 45 days of the service start date, the validity period of the selected plan begins on that day. However, if no communication occurs within 45 days, the validity period will begin on the 45th day from the service start date.
  4. The eSIM profile allows data communication immediately after activation; however, the first additional data plan recharge can only be made after 24 hours have passed since eSIM activation.
  5. The eSIM profile is provided through a GSMA-compliant consumer eSIM platform, but operation on all eSIM-compatible devices is not guaranteed.

Article 11 (Service Usage Requirements)

The following requirements apply to the use of this Service:

  1. The Contractor may not use this Service with IP addresses other than those specified by the Company.
  2. The Contractor is prohibited from using the Service through any communication means other than the SIM and from making any connections other than those specified by the Company.
  3. The Contractor must comply with the following regarding the SIM:
    1. Except with the Company's consent, the Contractor must not disassemble, damage, reverse engineer the software, or use the SIM for any purpose other than its intended use.
    2. Except with the Company's consent, the Contractor must not take the SIM out of Japan.
    3. The Contractor must manage the SIM card with the utmost care.
  4. No replacement will be provided if the SIM is lost or damaged.
  5. The Contractor may not use terminal equipment that does not conform to the technical standards specified by law or the terminal equipment designated by the Company for this Service.

Article 12 (System Maintenance)

  1. The Company and the internet provider will perform regular maintenance every Tuesday from 22:00 to 09:00 the following day (Japan time) to ensure quality, expand, maintain, and preserve equipment. If the Company deems it necessary, emergency maintenance may be carried out without prior notice to address urgent issues with the service equipment.
  2. During regular maintenance periods, issuing eSIM profiles, activation procedures, and additional data plan recharges will be unavailable.

Article 13 (Restrictions on Use Related to Child Pornography)

The Company may restrict communication related to viewing or obtaining child pornography, as defined by laws concerning the punishment of acts related to child prostitution and child pornography, and the protection of children.

Article 14 (Measures Against Cyber Attacks)

The Company may automatically detect query logs generated by name resolution requests to DNS servers to block communication with servers involved in cyber-attacks, such as Command and Control (C&C) servers. The Contractor may adjust settings at any time after starting to use this Service to prevent such detection and blocking.

Article 15 (Service Suspension)

The Company may suspend the provision of this Service due to maintenance, equipment failures, or other unavoidable issues related to its telecommunications infrastructure or that of the internet provider. In such cases, the Company will make efforts to notify users of the suspension by posting information on its relevant website.

Article 16 (Service Use Suspension, etc.)

The Company may suspend or restrict the provision of all or part of this Service if any of the following conditions apply to the Contractor:

  1. The Contractor violates any obligations specified in these Terms and Conditions.
  2. The Contractor uses this Service in an illegal manner or in a way that is clearly against public order and morals.
  3. The Contractor uses this Service in a manner that significantly obstructs the use of services provided directly or indirectly by the Company.
  4. The Contractor uses this Service in a way that may damage the reputation of the Company's services.
  5. The Contractor uses this Service in any manner that the Company deems inappropriate.

Article 17 (Contract Termination)

The Company may terminate this Service contract if any of the following conditions apply to the Contractor:

  1. If 30 days have passed since the suspension of service or other action as outlined in the previous article, and there has been no contact from the Contractor.
  2. If the Service suspension or other action, as mentioned in the previous article, has been implemented and the Company determines that the issue leading to the suspension has not been resolved.

Article 18 (Limited Warranties and Liability)

  1. The Company makes no warranties regarding the availability, latency, or overall quality of communication related to this service.
  2. The Company is not liable for any damages incurred by the Contractor in connection with the use of this Service, regardless of the cause. However, this exclusion of liability does not apply in cases of intentional wrongdoing or gross negligence by the Company.
  3. If the Company compensates a third party for damages resulting from the Contractor's use of this Service, the Company may seek reimbursement from the Contractor for such compensation.

Article 19 (Language)

The "Prepaid Data Top SIM Service Contract Terms" written in Japanese constitute the official contract between the Company and the Contractor. Documents in other languages are provided for reference only and do not constitute the official contract.

Article 20 (Governing Law and Exclusive Jurisdiction)

These Terms and Conditions shall be governed by and interpreted by the laws of Japan. In the event of any disputes between the Company and the Contractor that require litigation, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
